Terms of Use

I. Introduction

These Terms set out the agreement between you and PB Solutions Co., Ltd ("we", "us", or "our") regarding the use of the e-Scanner application and its official website. By downloading, accessing, or using e-Scanner, you agree to these terms. If you do not agree, please refrain from using the application.

II. Changes to Terms

We may update these Terms from time to time. The "Last Updated" date at the top of the page always reflects the current version. Your continued use of the application after any changes take effect constitutes acceptance of the updated Terms.

III. Eligibility

You must be at least 13 years old (or 16 years old where required by local law) to use the app. If you are under the legal age of majority in your jurisdiction, you may only use e-Scanner with the consent of a parent or legal guardian, and any subscription purchases must be completed by them.

IV. How the App Operates

e-Scanner operates on a local-first architecture. Core functions, including document capturing, editing, organizing, exporting, and standard PDF tools, are executed directly on your device and work completely offline.

Only two optional feature groups require an internet connection: Advanced OCR (which includes PDF to Word conversion and text extraction) and Word to PDF conversion. These are the only tools that transmit files off your device for processing (further detailed in Sections IX and X). All other features operate strictly offline, regardless of whether these optional tools are enabled.

V. Privacy

How your data is processed is detailed in our Privacy Policy, which forms an integral part of these Terms. By using e-Scanner, you agree to the policy outlined therein.

VI. License & Ownership

• License GrantWe grant you a personal, non-exclusive, non-transferable, and revocable license to use the app on devices you own or control, in accordance with the App Store Terms of Service.
• RestrictionsYou may not copy, modify, translate, reverse engineer, decompile, rent, resell, redistribute the app, or remove any proprietary notices. The app, its branding, and design remain our exclusive property.
• Your Content OwnershipYou retain full ownership of all scanned, imported, or created content. We claim no rights or licenses over your content and process it solely to perform your requested actions.

VII. Prohibited Activities

You are solely responsible for the documents you scan and process, and you must possess the legal right to do so. You agree not to use e-Scanner to:

• Illegal ActionsViolate any applicable laws or process documents you are not legally authorized to handle.
• Infringing RightsInfringe upon the legal rights of others, or generate fraudulent, deceptive, or falsified documents.
• Service AbuseExceed usage limits, automate requests, or degrade service quality for other users. We reserve the right to rate-limit or block such requests.

VIII. Service Availability & Accuracy

• Feature ChangesWe may add, modify, or temporarily suspend online features for maintenance or due to circumstances beyond our control. We strive to maintain features included in your active paid subscription.
• Accuracy DisclaimerText recognition (OCR) and file conversions are automated and may occasionally contain errors. Please carefully review important documents before relying on them.
• Data BackupYou are responsible for backing up your essential files. Because data is stored locally on your device, lost or damaged devices, or app uninstallation, will result in the loss of your library.

IX. Free Plan, Premium & Payments

• Free Plan Limits10 Advanced OCR pages/month, merge up to 3 files per attempt, maximum 5 images per PDF. Applicable limits are displayed where features are used.
• Premium PlanAuto-renewable monthly or annual subscription. Increases Advanced OCR quota to 150 pages/month (max 30 pages/day), removes file and image limits, and unlocks PDF password locking and unlocking tools.
• Adjustable QuotasThe applicable quota is always the number displayed within the app at the time you use the feature.
• PaymentCharged to your Apple ID account upon purchase confirmation and at each renewal period.
• CancellationCancel via iOS Settings > [Your Name] > Subscriptions at least 24 hours before the current period ends; otherwise, the subscription auto-renews.
• Restoring PurchasesReinstalling or switching devices? Select "Restore Purchases" in the app's Settings.
• Subscription ExpirationThe app reverts to the Free Plan. Your documents remain untouched, un-deleted, and fully accessible.
• RefundsPayments are processed directly by Apple. Refund requests must be submitted to Apple in accordance with Apple's refund policies.

X. Third-Party Services

• Optional FeaturesAdvanced OCR features are disabled by default and only operate when explicitly enabled and confirmed by you.
• Transmitted DataSelected files are transmitted to our servers for processing within the quotas shown in the app. Our Privacy Policy details how these files are handled and when they are deleted.
• Potential InterruptionsThese features require an internet connection and rely on external services beyond our control, meaning they may experience delays, changes, or interruptions. Core scanning and document management remain completely unaffected.
• Third-Party ProvidersThe full list of third-party providers is detailed in Section IV of our Privacy Policy. Each provider's terms and privacy policy apply to their respective services.

XI. Disclaimer of Warranties

• "As Is" BasisThe application is provided on an "as is" and "as available" basis. We do not warrant that processed results will be accurate, complete, uninterrupted, error-free, or fit for a particular purpose.
• Irrecoverable DataIf you lose a PDF password, forget your app lock PIN, or empty items from the Trash, neither we nor any third party can recover them. There are no backdoors; this is an intentional security design to safeguard your privacy.

XII. Limitation of Liability

• Exclusion of DamagesWe shall not be liable for any indirect, incidental, special, or consequential damages, loss of profits, or loss/corruption of data arising out of or related to your use of e-Scanner.
• Liability CapWhere legal liability cannot be fully excluded, our maximum aggregate liability is capped at the total amount you paid to us during the 12 months preceding the claim.
• Statutory Consumer RightsNothing in these Terms limits or excludes any liabilities that cannot be limited or excluded under applicable law, including your statutory consumer rights.

XIII. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Vietnam. If you are a consumer, you retain the full protection of mandatory consumer protection laws in your country of residence and may bring legal proceedings in your local courts where applicable.

Before initiating any formal legal action, please contact us first. Most concerns can be resolved quickly and amicably through direct communication.

XIV. Termination

You may terminate your use of e-Scanner at any time by uninstalling the application. We reserve the right to suspend or terminate your access to online features if you materially breach these Terms (such as attacking our service infrastructure or using the app unlawfully).

Any termination or suspension of access to online features does not affect or alter any documents stored locally on your device.

XV. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

XVI. Apple-Specific Terms

• Parties InvolvedThese Terms are between you and PB Solutions Co., Ltd only, not with Apple. Apple is not responsible for the e-Scanner application or its content.
• Maintenance & SupportWe are solely responsible for providing any maintenance and support services. Apple has no obligation whatsoever to furnish such services.
• WarrantyIn the event of any failure of the app to conform to any applicable warranty, you may notify Apple for a refund of the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
• ClaimsWe, not Apple, are responsible for addressing any claims relating to the app, including product liability, legal compliance, consumer protection, and third-party intellectual property infringement claims.
• Third-Party BeneficiaryApple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce these Terms against you.
